释义	法律分析：贷款人死亡的后，如果其亲属继承遗产的，要在继承的遗产范围内偿还贷款；家属没有继承遗产的，直接用贷款人的遗产偿还贷款，剩余部分，由他的继承人依法继承。贷款人遗产不足以偿还的部分，担保人要承担担保责任，由担保人负责偿还。法律依据：《中华人民共和国民法典》第一千一百六十三条既有法定继承又有遗嘱继承、遗赠的，由法定继承人清偿被继承人依法应当缴纳的税款和债务；超过法定继承遗产实际价值部分，由遗嘱继承人和受遗赠人按比例以所得遗产清偿。
