释义	法律分析: 视情况而定，定金的使用方式是退回交付定金方或者冲抵主合同应当支付的款项。定金基本种类是：1、立约定金；2、成约定金；3、证约定金；4、违约定金；5、解约定金。以上第4和第5种定金可以退回。法律依据: 《中华人民共和国民法典》第五百八十七条给付定金的一方不履行债务或者履行债务不符合约定，致使不能实现合同目的的，无权请求返还定金收受定金的一方不履行债务或者履行债务不符合约定，致使不能实现合同目的的，应当双倍返还定金。
