释义	企业破产土地出让要缴土地增值税吗要缴。清算组处置破产企业国有土地权时，应按规定缴纳土地增值税。根据《城市房地产管理法》规定，以划拨方式取得土地使用权的，转让房地产时，应当按照国务院规定，报有批准权的人民政府审批。有批准权的人民政府准予转让的，应当由受让方办理土地使用权出让手续，并依照国家有关规定缴纳土地使用权出让金。因此，对受让方依照国家有关规定缴纳的土地使用权出让金及按国家统一规定交纳的有关费用可以在计算增值额时扣除。
