释义	法律分析：每种犯罪的刑事处罚是不同的，但有共同点，即达到刑事责任能力。不满14周岁的公民犯罪不受处罚，为完全不负刑事责任时期在14周岁至16周岁间，为相对负刑事责任时间。 16周岁后为完全负刑事责任时期，但是应当从轻或减轻处罚，这也是一部分的原因。法律上还有别的一些法定情节可以免除从轻或者减轻情节。刑事处罚主要是人身罚和财产罚，主刑和附加刑都是关于这两类的处罚。法律依据：《刑法》第四条，适用刑法人人平等，对任何人犯罪，在适用法律上一律平等。不允许任何人有超越法律的特权。
