休产假是否有绩效奖金

法律主观：

通常情况下，绩效工资是要根据工作成果来确定数额的。产假期间的工资标准依据相关法律规定，系以之前一定时间内的平均工资作为标准，其之前的工资中已经包含之前的绩效奖金，因此绩效奖金不能扣除。

法律客观：

《女职工劳动保护特别规定》第八条，女职工产假期间的生育津贴，对已经参加生育保险的；按照用人单位上年度职工月平均工资的标准由生育保险基金支付；对未参加生育保险的，按照女职工产假前工资的标准由用人单位支付。
