释义	1、如果没有结婚的一方在不知道对方已结婚的情形下与之结婚的，则不知情的当事人不构成重婚罪。对重婚构成犯罪的，依法追究刑事责任。2、明知他人有配偶而与他人以夫妻名义共同生活，涉嫌重婚罪，两年以下有期徒刑或拘役。即第三者也是需要承担责任的。所谓明知他人有配偶而与之结婚的，是指本人虽无配偶，但明知对方有配偶，而故意与之结婚的(包括登记结婚或者事实婚)。如果没有配偶一方确实不知对方有配偶而与之结婚或以夫妻关系共同生活的，无配偶一方不构成重婚罪，有配偶一方则构成重婚罪。
