释义	担保人没签合同不算借款人。因为只有当保证人和债权人签订了保证合同，双方之间才存在保证合同为其设立的民事法律关系。总之，没有签字的保证合同在法律上是无效的。【法律依据】《民法典》第四百六十四条，合同是民事主体之间设立、变更、终止民事法律关系的协议。第六百八十二条，保证合同是主债权债务合同的从合同。主债权债务合同无效的，保证合同无效，但是法律另有规定的除外。保证合同被确认无效后，债务人、保证人、债权人有过错的，应当根据其过错各自承担相应的民事责任。
