释义	担保人没签合同不算借款人。没有签字担保合同是无效的。当事人采用合同书形式订立合同的，应当签字或者盖章。当事人在合同书上摁手印的，人民法院应当认定其具有与签字或者盖章同等的法律效力。因此，对于合同来说是有效的，但是担保人没有签字那么作为担保合同就是无效的。对于担保人来说就不能承担相应的法律责任，自然也不能成为偿还借款的人。法律依据《民法典》第四百九十条
