释义	犯罪的时候不满十八周岁的人不适用死刑，从18岁生日次日开始计算即使是审判时已满十八周岁，也不能适用死刑。行为人在年满十八周岁前后实施同种犯罪行为，如果十八周岁后的犯罪行为与十八周岁前的犯罪行为能够相互区分，且可以单独被评价为犯罪，则应当认定为“犯罪时已满十八周岁”。法律依据《中华人民共和国刑法》第十七条
