释义	法律分析: 劳动者签订劳动合同一般签字或者按指印，自己有私人印章，经过公安机关备案且用人单位同意的，可以盖私章。用人单位员工代替用人单位与劳动者签订劳动合同，包括人事部门员工或者入职的法定代表人，获得用人单位授权的，可以在劳动合同上盖用人单位公章或者劳动合同专用章。《中华人民共和国劳动合同法》第十六条劳动合同由用人单位与劳动者协商一致，并经用人单位与劳动者在劳动合同文本上签字或者盖章生效。劳动合同文本由用人单位和劳动者各执一份。
