释义	法律分析：罪犯需要保外就医的，应当由罪犯本人或者其亲属、监护人提出保证人，保证人由监狱、看守所审查确定。罪犯没有亲属、监护人的，可以由其居住地的村(居)民委员会，原所在单位或者社区矫正机构推荐保证人。保证人应当向监狱、看守所提交保证书。法律依据：《看守所留所执行刑罚罪犯管理办法》第二十条罪犯需要保外就医的，应当由罪犯或者罪犯家属提出保证人。保证人由看守所审查确定。
