收养关系无效的法条

法律主观：

    收养关系认定无效的情况有：
    1、收养违反被收养人的真实意愿；
    2、收养人没有向县级以上人民政府民政部门申请收养登记；
    3、收养人不符合法律规定的收养条件。

法律客观：

《中华人民共和国民法典》第一千一百一十七条收养关系解除后，养子女与养父母以及其他近亲属间的权利义务关系即行消除，与生父母以及其他近亲属间的权利义务关系自行恢复。但是，成年养子女与生父母以及其他近亲属间的权利义务关系是否恢复，可以协商确定。
