释义	1.延长诉讼时效所依据的正当理由(事由)是由人民法院合依职权确认的，因为社会生活的复杂性决定了法律不可能将阻碍诉讼时效进行的情况全部地加以规定。当出现中止和中断诉讼时效的法定事由之外的事实即特殊情况，造成权利人逾期行使请求权时，有必要授权人民法院审查是否作为延长时效的事由，以弥补法律规定的不足。而所谓特殊情况而不指权利人由于障碍在法定诉讼时效期间不能行使请求权的情况。 2.诉讼时效的延长适用于已经届满的诉讼时效。已完成的诉讼时效期间仍然有效力，而由人民法院决定适当延长一定的期间。
