释义	法律分析：行为人如明知其未满十四周岁仍与其发生性关系，不管未成年人是否自愿均构成猥亵儿童罪。但未成年人确实早熟且隐瞒真实年龄，行为人确实无法从起外貌特征判断其真实年龄的，双方自愿且未造成严重后果的，原则上不认为是犯罪。法律依据：《中华人民共和国刑法》二百三十七条猥亵儿童罪以暴力、胁迫或其他方法强制猥亵妇女或者侮辱妇女的，处五年以下有期徒刑或者拘役。聚众在公共场所当众犯前款罪的，处五年以上有期徒刑。猥亵儿童的，依照前两款规定从重处罚。
