释义	公司成立不到一年能变更法人。变更法人是指法人成立后，其组织、名称、住所、经营范围等重要事项发生的变更。但是在一年之内公司的名称不能进行变更。法人不是法定代表人，法人是具有民事权利能力和民事行为能力，依法独立享有民事权利和承担民事义务的组织。《中华人民共和国市场主体登记管理条例》第二十四条市场主体变更登记事项，应当自作出变更决议、决定或者法定变更事项发生之日起30日内向登记机关申请变更登记。市场主体变更登记事项属于依法须经批准的，申请人应当在批准文件有效期内向登记机关申请变更登记。
