释义	法律分析: 行为犯是犯罪既遂的类型之一，是以既遂为模本。按照这种观点，如果是行为犯，只要实施了行为，那么就是既遂，不存在未遂情况。但如果依此，则难以解决司法实践中的一些问题，难以做到罪责刑相适应，无法让人接受，也无法发挥刑法的预防和阻却作用，尤其在涉及到行为有一个实行过程的行为犯，比如销售、贩卖类型的犯罪。法律依据: 《中华人民共和国刑法》二十三条已经着手实行犯罪，由于犯罪分子意志以外的原因而未得逞的，是犯罪未遂。
