释义	根据《刑法》第二百五十八条规定，事实上重婚的认定为：1、非法同居行为具有持续性，只有这种非法的关系存续一定的期间才能构成重婚罪的条件，而此期间内的非法同居行为是呈持续实行状态；2、非法同居所致的非法婚姻关系与非法同居同时存在，且为继续状态，非法同居不停止，非法的婚姻关系就始终继续。因此，事实重婚为继续犯，追诉期应当从非法婚姻关系终了之日起计算。
