法律分析：
返聘退休人员属于劳务关系，劳务报酬根据双方合同约定为准。单位雇用达到法定退休年龄的劳动者，既不存在签订劳动合同的可能，亦无法为其缴纳社保劳务人员不受劳动法及劳动合同法保护，即不享有一般劳动者的权利。
法律依据：
《中华人民共和国劳动法》
第二十一条 劳动者达到法定退休年龄的，劳动合同终止。
第四十八条 国家实行最低工资保障制度。最低工资的具体标准由省、自治区、直辖市人民政府规定，抱国务院备案。
