释义	主体要件。本罪主体要件，是特殊主体，即必须具有司法职权的国家司法工作人员，实际能构成其罪的，则为那些具有报请或者决定减刑、假释、暂予监外执行职权的司法工作人员，非上述人员包括非司法工作人员以及虽为司法工作人员但没有报请或决定减刑、假释、暂予监外执行的职权，都不能单独构成本罪。与司法工作人员伙同进行本罪行为的，以共犯追究刑事责任。法律依据《中华人民共和国刑法》第四百零一条
