释义	法律分析: 根据当事人自行协商约定。共同买房时，一般在签订购房合同时候，购房人有二人以上，开发商会提供一份份额协议给购房人填写。里面主要有两条约定：一是明确写明各个购房人占有房屋的份额，二是不约定各人占有份额，直接按照平均分配的额度来确定占有份额。法律依据: 《中华人民共和国民法典》第三百零九条按份共有人份额的确定按份共有人对共有的不动产或者动产享有的份额，没有约定或者约定不明确的，按照出资额确定能确定出资额的，视为等额享有。
