释义	法律主观：员工能要求企业提供加班依据。正常情况下用人单位要求劳动者延长工作时间，首先必须是由于生产经营需要，其次要与工会和劳动者协商，用人单位不得强迫劳动者加班，也就是说劳动者若不同意加班有权拒绝。除此之外，延长工作时间的长度也不是随意的，一般每日不超过1小时，因特殊原因需要延长时间的，在保障劳动者身体健康的条件下延长工作时间不得超过3小时，但是每个月不得超过36小时。
