释义	法律分析：免责条款有效性取决于是否违反了法律规定、是否与借款人根据信息不对等原则而签订、是否剥夺了借款人的合法权益等因素。一般来说，免责条款不能免除出借人故意或重大过失致使借款人损失的责任。(不得违反法律原则) 法律依据：《中华人民共和国合同法》第四十一条依法成立的合同，对当事人具有法律约束力。第一百六十七条当事人可以约定免除债务人的违约责任或者减轻债务人的违约责任。但是，法律另有规定的除外。第一百七十六条出借人的过错或者故意给借款人造成损失的，出借人应当承担赔偿责任。
