释义	对于累犯，应当从重处罚。《刑法》第六十五条规定：“被判处有期徒刑以上刑罚犯罪分子，刑罚执行完毕或者赦免以后，在5年以内再犯应当判处有期徒刑以上刑法之罪的，是累犯，应当从重处罚，但过失犯罪除外。”从法条可以看出，累犯属于一种“从重”处罚的情节，而不是“加重”处罚的情节，即只能在同一量刑幅度内适用相对较重的刑罚，而不能适用更重的刑种和刑度。我国刑法未对累犯做加重处罚的规定，而是重申了对累犯“从重处罚”的原则。
