问题	侵犯专利权的行为如何处理
释义	擅自实施他人专利，应受到下列处罚：一、假冒他人专利的。1、承担民事责任(赔偿专利权人的损失)；2、由管理专利工作的部门给予下列处分：(1)责令改正并予以公告；(2)没有违法所得；(3)并处违法所得三倍以下罚款，没有违法所得的，处以五万元以下罚款；(4)构成犯罪的，依法追究刑事责任。二、以非专利产品冒充专利产品、以非专利方法冒充专利方法：1、由管理专利工作的部门责令改正并予以公告；2、并处五万元以下罚款。法律依据《中华人民共和国专利法》第六十三条
