释义	法律分析：合同不生效是指合同已经成立，但尚未生效，当事人是可以解除合同的。这样的合同不具备生效合同的效力，也就是说一方无法请求对方履行。但它已经成立，又应当受到法律的保护，这种法律保护的内容就是不得擅自变更或者解除合同.只具有所谓的“形式拘束力”。法律依据：《中华人民共和国民法典》第五百六十二条当事人协商—致，可以解除合同。当事人可以约定一方解除合同的事由。解除合同的事由发生时，解除权人可以解除合同。
