同一法人两家公司能否交易
释义
法律分析：没有任何法律禁止同一法人代表的公司之间不能买卖,除非国家是国家限制买卖的货品。同一法定代表的两家公司之间的交易属于关联交易,交易价格必须按照公允价值(市场价格)进行交易,否则税务局有权进行调整,这也是涉税风险。
法律依据：《中华人民共和国公司法》 第十四条 公司可以设立分公司。设立分公司，应当向公司登记机关申请登记，领取营业执照。分公司不具有法人资格，其民事责任由公司承担。 公司可以设立子公司，子公司具有法人资格，依法独立承担民事责任。
