释义	法律分析：当企业因经营管理不善造成严重亏损，不能清偿到期债务的，依照企业破产法规定宣告破产。严重亏损是指无力清偿到期债务的企业，由其债权人或债务人向企业所在地法院提交破产申请。另外，如果企业具备了企业破产条件，其要进入破产程序还必须由人民法院依法裁定并宣告其破产，这样企业才正式进入破产程序。法律依据：《中华人民共和国企业破产法》第二条企业法人不能清偿到期债务，并且资产不足以清偿全部债务或者明显缺乏清偿能力的，依照本法规定清理债务。
