释义	法律分析：刑事犯罪的刑事责任年龄没有上限限定，只要构成犯罪都会追究刑事责任并执行刑罚。不过，对一定年龄的老人（生活自理能力障碍者）会本着人道主义原则予以宽济处罚，但“以特别残忍手段致人死亡的罪犯”除外。法律依据：《中华人民共和国刑法》第十七条已满七十五周岁的人故意犯罪的，可以从轻或者减轻处罚；过失犯罪的，应当从轻或者减轻处罚。第四十九条审判的时候已满七十五周岁的人，不适用死刑，但以特别残忍手段致人死亡的除外。
