对于、承揽合同与建设工程合同的区别这个问题，下面我将做简要分析。承揽合同与建设工程合同最大的不同有下面两点：一、合同的主体不同承揽合同的主体为一般主体，承揽人即可以是具有相应的资质的法人，也可以是其他单位或者个人，定作人可以是自然人、法人和其他组织。建设工程施工合同的主体为特殊主体，法律对建设工程合同的发包人和承包人的主体资格均有要求。发包人一般为建设工程的建设单位，承包人为具有从事勘察、设计、施工业务资格的法人，而且要具有相应的资质。自然人即不能成为建设工程合同的发包人，也不能成为承包人。这是两类合同最为显著的区别。二、合同标的物不同建设工程施工合同标的物是不动产。而承揽合同完成的工作标的物一般是指动产，比如原材料的加工承揽。

《公路工程勘察设计招标投标管理办法》 第七条 公路工程勘察设计招标是指招标人按照国家基本建设程序，依据批准的可行性研究报告，对公路工程初步设计、施工图设计通过招标活动选定勘察设计单位。公路工程勘察设计招标可以实行一次性招标、分阶段招标，有特殊要求的关键工程可以进行方案招标。
