释义	法律分析：已经在监狱服刑，说明判决书已经超过上诉期10天，判决已经发生法律效力，就不能上诉了。但是，如果认为判决有错误，可以向法院申请再审。再审申请书可以由监狱转交。法律依据：《中华人民共和国刑事诉讼法》第二百一十九条不服判决的上诉和抗诉的期限为十日，不服裁定的上诉和抗诉的期限为五日，从接到判决书、裁定书的第二日起算。第二百四十一条当事人及其法定代理人、近亲属，对已经发生法律效力的判决、裁定，可以向人民法院或者人民检察院提出申诉，但是不能停止判决、裁定的执行。
