释义	打击报复证人罪量刑规定为，行为人有实施打击报复证人行为的，判处三年以下有期徒刑或者拘役；情节严重的，处三年以上七年以下有期徒刑。该罪主观上要求行为人具有直接故意的意思表示。【法律依据】《中华人民共和国刑法》第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。第三百零八条对证人进行打击报复的，处三年以下有期徒刑或者拘役；情节严重的，处三年以上七年以下有期徒刑。
