嫖娼不会被拘留的情况为行为人已满十四周岁不满十六周岁；行为人已满十六周岁不满十八周岁，初次违反治安管理；行为人七十周岁以上；行为人怀孕了或者正在哺乳自己不满一周岁婴儿。

法律客观：

    《中华人民共和国治安管理处罚法》
    第六十六条
    卖淫、嫖娼的，处十日以上十五日以下拘留，可以并处五千元以下罚款；
    情节较轻的，处五日以下拘留或者五百元以下罚款。
    在公共场所拉客招嫖的，处五日以下拘留或者五百元以下罚款。
