释义	宅基地、土地的所有权不能继承，宅基地上的房屋及土地上的附着物可以继承。宅基地和土地属于集体经济组织所有。此外，根据”地随房走“的原则，宅基地的使用权也随之发生继承。但是如果继承人不是农村集体经济组织成员，宅基地上又没有房屋，那么宅基地的使用权就不能继承了。法律依据《中华人民共和国民法典》第一千一百二十二条遗产是自然人死亡时遗留的个人合法财产。依照法律规定或者根据其性质不得继承的遗产，不得继承。
