我国刑法对组织黑社会性质组织罪的立案规定?
释义
组织、领导或者参加黑社会性质的组织的，应当立案。本罪为行为犯，只要组织、领导了黑社会性质的组织或者参加了该组织，并不要求再实施其他犯罪行为和造成犯罪结果，原则上就构成犯罪，应当立案追究。
