释义	不举报亲人犯罪的行为，不构成包庇罪。包庇罪在客观方面主要表现为明知是犯罪分子，而向司法机关作假证明的行为，主要指自己向司法机关和有关组织出具口头或书面的假证明，意图使犯罪的人逃避法律追究。法律毕竟没有规定不举报的责任，单纯不提供证言、沉默不语或者不出庭作证行为，不成立包庇罪。【法律依据】《中华人民共和国刑法》第三百一十条明知是犯罪的人而为其提供隐藏处所、财物，帮助其逃匿或者作假证明包庇的，处三年以下有期徒刑、拘役或者管制；情节严重的，处三年以上十年以下有期徒刑。
