成都市申请工伤需要满足的流程是怎样规定的 |

一、成都市申请工伤流程
1、如果单位为职工交了工伤险：应由工伤保险机构赔偿，程序是：
(1)由单位在事故后30天内向劳动局申报工伤，有工伤认定书后申请劳动能力鉴定，然后由工伤保险机构赔偿。
(2)如果单位在30天内没有申报：工伤职工个人应在事故后一年内向所在地劳动局申请工伤认定，拿到工伤认定后申请劳动能力鉴定，有鉴定结果后按伤残等级向工伤保险机构申请赔偿。
2、如果单位没为职工交工伤险：由单位按《工伤保险条例》规定的标准进行赔偿，申请工伤认定和劳动能力鉴定的程序同上。
3、关于申请工伤认定和索要工伤赔偿：协商不成时，可以提起劳动仲裁解决。
二、认定标准
职工有下列情形之一的，应当认定为工伤：
1.在工作时间和工作场所内，因工作原因受到事故伤害的;
2.工作时间前后在工作场所内，从事与工作有关的预备性或者收尾性工作受到事故伤害的;
3.在工作时间和工作场所内，因履行工作职责受到暴力等意外伤害的;
4.患职业病的;
5.因工外出期间，由于工作原因受到伤害或者发生事故下落不明的;
6.在上下班途中，受到非本人主要责任的交通事故或者城市轨道交通、客运轮渡、火车事故伤害的;
7.法律、行政法规规定应当认定为工伤的其他情形。
三、认定资料
1、《工伤认定申请表》;
2、居民身份证;
3、医疗诊断证明/职业病诊断证明书;
4、劳动关系证明，例如劳动合同;
5、用人单位依法成立的登记证书或登记查询通知单;
6、死亡证明(职工死亡);
7、公安部门证明/其它相关证明(工作时间/场所，因工作职暴力伤害等意外伤害);
8、公安部门证明/相关部门证明(因工外出期间，因工作受到伤害或发生事故下落不明);
9、医疗机构抢救证明(突发疾病死亡或在48小时之内经抢救无效死亡);
10、民政部门/相关部门证明(抢险救灾等维护国家利益、公众利益活动中受到伤害);
11、《革命伤残军人证》、劳动能力鉴定机构旧伤复发确认文件(因战、因公负伤致残的转业/复员军人，旧伤复发);
12、事故责任认定证明(上下班途中，受到非本人主要责任的交通事故或城市轨道交通、客运轮渡、火车事故伤害的)。
