释义	小产权房是指在农村集体土地上建设的房屋，未办理相关证件，未缴纳土地出让金等费用，亦称“乡产权房”。小产权房没有国家发放的土地使用证和预售许可证，购房合同在国土房管局不会给予备案。所谓产权证亦不是真正合法有效的产权证。小产权房不能转正，小产权房本就是非法，不动产登记不可能改变宪法规定的土地所有制。根据《中华人民共和国土地管理法》的规定，农村宅基地属集体所有，村民对宅基地只享有使用权，农民将房屋卖给城市居民的买卖行为不受到法律的认可与保护，即不能办理土地使用证、房产证、契税证等合法手续。
