释义	法律分析：员工二次入职，是指员工与原单位解除劳动关系之后，与另一个单位建立劳动关系，或者与同一单位解除劳动关系之后，重新与该单位建立劳动关系。续签是指劳动合同期满，双方当事人均有继续保持劳动关系的意愿，经协商一致，延续签订劳动合同的法律行为。前者是一个断续的法律行为，后者是连续的法律行为，因此，二次入职不属于续签。法律依据：《中华人民共和国劳动合同法》第十六条劳动者违反竞业限制约定的，应当向用人单位支付违约金，其数额不得超过用人单位向劳动者支付的竞业限制经济补偿的三倍。
