3、本罪主体为一般主体。
4、本罪在主观方面表现为故意。
法律依据:
《中华人民共和国刑法》 第三百一十一条 明知他人有间谍犯罪或者恐怖主义、极端主义犯罪行为，在司法机关向其调查有关情况、收集有关证据时，拒绝提供，情节严重的，处三年以下有期徒刑、拘役或者管制。
