法律分析：
1、如果在工作过程中遇到事故伤害，应当马上到签订服务协议的医疗机构就医，情况紧急时可以先到就近的医疗机构急救。同时，及时向当地劳动保障行政部门申请工伤认定。工伤职工如果对劳动保障部门工伤认定结论不服，还可以在收到工伤认定书60日内提起行政复议；对复议决定不服的，还可以在15日内向当地人民法院提起行政诉讼。 2、被认定为工伤后，应拿着工伤认定书到当地劳动能力鉴定委员会申请伤残等级鉴定。拿到工伤认定书和伤残等级鉴定书之后，就可以到用人单位或劳动保障部门的工伤保险经办机构领取工伤保险待遇。如果所在单位没有参加工伤保险，工伤保险待遇由用人单位支付。用人单位参加了工伤保险的，就由工伤保险经办机构从工伤保险基金中按标准支付工伤保险待遇

第九条 交通费根据受害人及其必要的陪护人员因就医或者转院治疗实际发生的费用计算。交通费应当以正式票据为凭;有关凭据应当与就医地点、时间、人数、次数相符合。
第十一条 营养费根据受害人伤残情况参照医疗机构的意见确定。
