当事人除向法院缴纳诉讼费外，还应当缴纳证人、鉴定人、翻译人员在人民法院决定日期出庭的交通费、住宿费、生活费、误工补偿费。根据该规定证人出庭作证支出的合理费用应包括交通费、住宿费、生活费、误工补偿费。交通费、住宿费以实际支出的费用为准，但不宜过高。生活费用，应按照当地人均生活消费水平计算。误工补偿费，应按照证人的工资或参照同行业的标准计算，无业的可参照证人当地生活水平标准计算。证人出庭作证所支出的费用，法律规定由败诉方当事人承担。
一、证人出庭作证所支出合理费用的预交
法律规定费用由举证方当事人预交，这是证人出庭作证所支出合理费用预交的一般原则。司法实践中预交证人出庭费用还应考虑证人出庭的方式及当事人的经济能力，而由法院指定当事人一方或双方预交证人出庭费用。
1、证人主动出庭为一方当事人作证，由举证方当事人预交。
2、一方当事人申请法院传唤证人出庭作证，由申请方当事人预交。
3、证人自愿出庭作证或法院依职权主动传唤证人出庭作证，法院指定一方或双方当事人预交。法院指定当事人预交证人出庭费用时，还应考虑当事人的经济能力，如果举证方当事人确实无能力预交证人出庭费用，法院可以指定对方当事人预交。证人出庭所支出的费用，证人应直接向法院领取。因为根据我国法律规定证人是法庭的证人，只对法庭负责，而不对任何一方当事人负责，证人只在法庭上就所知道的案件事实，做实事求是的陈述，以便于法庭查清案件事实，作出正确裁决。
