发明专利权的时效是什么

法律分析：专利权的法律保护的时效性包括二个方面：其一是专利权必须是专利的保护期限内的有效专利。具体到我国来说，发明专利的保护期为20年，实用新型和外观设计专利的保护期为10年。其二是专利的诉讼时效。我国《专利法》第61条：侵犯专利权的诉讼时效为二年，自专利权人或者利害关系人得知或应当得知侵权行为之日起计算。
法律依据：《中华人民共和国专利法》 第六十一条 侵犯专利权的诉讼时效为二年，自专利权人或者利害关系人得知或应当得知侵权行为之日起计算。
