释义	根据《刑法》第22条第2款的规定，对于预备犯，可以比照既遵犯从轻、减轻或者免除处罚。显然，预备犯应当负刑事责任。但由于预备犯还没有着手实行犯罪，没有造成犯罪结果，其社会危害性通常小于“既遂犯”的社会危害性，故对于预备犯，可以从宽处罚。只有在特殊情况下，如行为人准备实行特别严重的犯罪、手段特别恶劣时，也可以不予从轻、减轻或者免除处罚。
