彩礼钱不返还协议书有效吗? |

如果签订协议之后，双方办理了离婚登记，这对双方是具有约束力的，如果协议离婚未成，就不能生效。
1.对于签订协议后双方即办理离婚登记的情形，该协议成立并生效，协议内容对双方当事人均有约束力。
2.但在签订协议后未办理离婚登记的情形下，当事人达成的以登记离婚或者到人民法院协议离婚为条件的财产分割协议，如果双方协议离婚未成，一方在离婚诉讼中反悔的，人民法院应当认定该财产分割协议没有生效，并根据实际情况依法对夫妻共同财产进行分割。”就双方签订彩礼返还协议后并未办理离婚登记的案件，亦应按上述规定处理。
3.这对于均衡双方当事人的合法权益，避免当事人因欠缺法律知识做出错误的意思表示提供最后的救济途径。
离婚时是否需要把彩礼返还，需要看具体的情况。如果结婚已经超过半年，并且孕育了子女，彩礼也用于共同生活上，那么彩礼一般是不会支持要回的。彩礼是当地的风俗习惯最终是为了缔结婚姻关系，其有明显的风俗性。
一、协议离婚反悔合法吗？
在协议离婚后，夫妻可以对离婚协议表示反悔，其反悔的行为是合法的，但是不一定能反悔成功，如果双方还没有去民政局申请离婚登记，离婚协议书还没有生效，该由双方协商。如果已经办理了离婚登记手续，当事人可以向人民法院起诉请求重新分割，但是必须是订立财产分割协议时存在欺诈、胁迫等情形的才可以重新分割。
