释义	双方都是军人的离婚案件或者军人一方提出离婚的，应先经当事人所在部队政治机关审查、调解，无效时再由部队政治机关提出处理意见，然后由人民法院审理判决。非军人一方提出离婚的，须经军人同意；如军人不同意，而且原婚姻基础和婚后感情较好，非军人一方又无重要、正当理由的，应对非军人一方进行说服，教育其珍惜与军人的婚姻关系。法律依据《中华人民共和国民法典》第一千零八十一条【军婚的保护】现役军人的配偶要求离婚，应当征得军人同意，但是军人一方有重大过错的除外。
