1.取消中、小学教师职称工资。目前教师工资以职称取酬，由于学校中、高级职称有名额限制的，特别是高级。达到条件的教师远远多于限制的名额，造成资历、学历、能力、工作量、成果差不多的教师之间(尤其农村义务教育的教师)收入差距过大：高级与初级相差接近一半。2.教师收入由：基本工资、教龄工资、绩效工资、特优津贴等构成。3.退休教师工资计算方法。国发[1997]26号文件实施前参加工作，本决定实施后退休且缴费年限累计满15年的人员，在发给基础养老金和个人账户养老金的基础上，再发给过渡性养老金。各省、自治区、直辖市人民政府要按照待遇水平合理衔接、新老政策平稳过渡的原则，在认真测算的基础上，制订具体的过渡办法，并报劳动保障部、财政部备案。

第二条 本法适用于在各级各类学校和其他教育机构中专门从事教育教学工作的教师。
第三条 教师是履行教育教学职责的专业人员，承担教书育人，培养社会主义事业建设者和接班人、提高民族素质的使命。教师应当忠诚于人民的教育事业。
第四条 级人民政府应当采取措施，加强教师的思想政治教育和业务培训，改善教师的工作条件和生活条件，保障教师的合法权益，提高教师的社会地位。 全社会都应当尊重教师。
第五条 国务院教育行政部门主管全国的教师工作。国务院有关部门在各自职权范围内负责有关的教师工作。学校和其他教育机构根据国家规定，自主进行教师管理工作。
