释义	法律分析: 刑事诉讼法规定严禁刑讯逼供和威胁、引诱、欺骗以及其他非法的方法收集证据。从法律这一规定来说，通过刑讯逼供直接取得的证据是无效的。不能使用。法律依据: 《中华人民共和国刑法》第二百四十七条司法工作人员对犯罪嫌疑人、被告人实行刑讯逼供或者使用暴力逼取证人证言的，处三年以下有期徒刑或者拘役。致人伤残、死亡的，依照本法第二百三十四条、第二百三十二条的规定定罪从重处罚。
