商检失职罪既遂法院如何判

法院对商检失职罪既遂的判刑规定是:国家商检部门、商检机构的工作人员严重不负责任，对应当检验的物品不检验，或者延误检验出证、错误出证，致使国家利益遭受重大损失的，处三年以下有期徒刑或者拘役。构成该罪的行为主体在主观上是过失的心态。
法律依据:《《中华人民共和国刑法》》第十五条
【过失犯罪】应当预见自己的行为可能发生危害社会的结果，因为疏忽大意而没有预见，或者已经预见而轻信能够避免，以致发生这种结果的，是过失犯罪。
过失犯罪，法律有规定的才负刑事责任。
