释义	法律分析: 行为人进看守所的，不一定会判刑。人民法院只有在案件事实清楚，证据确实、充分，依据法律认定被告人有罪的情况下，才会判刑。如果人民法院认为依据法律认定被告人无罪的，则不会判刑。《中华人民共和国看守所条例》第二条看守所是羁押依法被逮捕、刑事拘留的人犯的机关。被判处有期徒刑一年以下，或者余刑在一年以下，不便送往劳动改造场所执行的罪犯，也可以由看守所监管。
