释义	法律分析：孩子八个月了可以离婚，但是这个时候男方不能提出来离婚，因为此时女方分娩尚未满一年，法律规定，女方分娩后一年内男方不得提出离婚。除非存在法院应当受理男方诉讼请求的情形的，男方可以提出离婚。所谓法院应当受理男方诉讼请求的情形是指女方怀孕是婚后与他人通奸所致；男方受虐待，不堪忍受等情形。法律依据：《民法典》第一千零八十二条，女方在怀孕期间、分娩后一年内或者终止妊娠后六个月内，男方不得提出离婚；但是，女方提出离婚或者人民法院认为确有必要受理男方离婚请求的除外。
